From Riba to Ridha: Innovation in Handling Non-Performing Loans in Sharia Property Developer Schemes

This study aims to analyze the strategies for handling non-performing financing (NPF) in Islamic Home Ownership Financing (KPR Syariah) implemented by Developer Property Syariah (DPS) D’Ahsana Kedanyang Gresik. The research employs a qualitative descriptive approach through field studies supported by literature review. Data were collected through in-depth interviews, direct observation, and documentation involving management representatives and debtors as key informants. The findings reveal two main causes of non-performing financing: internal factors such as weak communication and inadequate post-contract monitoring, and external factors including income decline, job loss, and family hardships. D’Ahsana applies two major strategies: a preventive strategy through contract restructuring, payment rescheduling, and persuasive negotiation; and a repressive strategy by facilitating voluntary house sales without imposing fines or foreclosure. These strategies are grounded in Islamic economic principles such as ta’awun (mutual help), ukhuwah islamiyah (Islamic brotherhood), and maslahah (public interest), in line with the maqashid al-shariah framework emphasizing justice and welfare. The novelty of this research lies in its integrated spiritual, social, and economic approach to credit recovery, which prioritizes humanitarian values over material gains. This model can serve as a reference for Islamic property developers and non-bank financing institutions in building a just and sustainable Islamic economic system.
